It may not be the contrite disposition you would wish; the employee may respond in anger. Get a lawyer involved right away. In addition, when the jobholder is over 40 and the replacement is younger, you should worry about age discrimination claims. If you make an error when terminating a hostile employee, you could be condemning the company to bankruptcy or liquidation.
A dismissing reason can be legitimate, illegal or just plain stupid. If you are in a position of authority, you must know how to dismiss an employee. If the jobholder changes his mind, you could lose the money and still face a litigation! Document well and act professionally.
